ACTION NARRATIVE 4:39:50 PM CHAIR JOSHUA REVAK called the Senate Resources Standing Committee meeting to order at 4:39 p.m. Present at the call to order were Senators Kiehl, Micciche, Stevens and Chair Revak. Senator Kawasaki arrived immediately thereafter. SB 148-BOATING SAFETY EDUCATION REQUIREMENT 4:40:19 PM CHAIR REVAK announced the consideration of SENATE BILL NO. 148 "An Act relating to mandatory boating safety education; relating to operating a boat; providing for an effective date by repealing the effective dates of secs. 3, 5, 7, 9, 11, 14, 16, 18, 20, 23, 26, and 27, ch. 28, SLA 2000, sec. 3, ch. 119, SLA 2003, sec. 2, ch. 31, SLA 2012, and secs. 5 and 8, ch. 111, SLA 2018; and providing for an effective date." He noted that this was the second hearing and there was a committee substitute (CS) for the members to consider. 4:40:23 PM SENATOR KAWASAKI joined the meeting. 4:40:59 PM CHAIR REVAK solicited a motion. 4:41:03 PM SENATOR MICCICHE moved to adopt the committee substitute (CS) for SB 148, work order 32-LS1144\O, as the working document. CHAIR REVAK objected for discussion purposes. 4:41:30 PM ED KING, Staff, Senator Roger Holland, Alaska State Legislature, Juneau, Alaska, presented the summary of changes in the CS for SB 148: [Original punctuation provided.] Summary of Changes from Version W to O Sec. 1 No Changes Sec. 2 Removes statutory references the National Association of State Boating Law Administrators, leaving it up to the department to establish those minimum standards in regulation Sec. 3 Makes four changes: 1. Deletes references to age in the bill 2. Corrects the Coast Guard terminology from "commercial operator's license" to "merchant mariner credentials" 3. Eliminates paragraph (7) from version W, as the intent is captured in paragraph (1) MR. KING said that the residency requirement in paragraph (7) of the bill was eliminated. The non-residency language became unnecessary since paragraph (1) captures the minimum requirement for out-of-state programs to qualify. 4. Clarifies that a boating insignia on a driver's license or state ID provides proof of course completion, not eligibility Sec. 4 Version O eliminates the fine for not taking the course, leaving the program as a "soft" requirement rather than a strong mandatory one Sec. 5(now 4) Conforming changes Sec. 6(now 5) Conforming changes Sec. 7(now 6) No changes Sec. 8(now 7) No changes Sec. 9 (now 8) No changes 4:42:55 PM CHAIR REVAK expressed his appreciation for the changes to SB 148. The bill sponsor worked with the committee on the changes. SB 148 encourages boater safety education and courses. The bill also takes into consideration the unique, different challenges in rural Alaska. 4:43:38 PM At ease. 4:43:45 PM CHAIR REVAK reconvened the meeting and withdrew his objection. 4:43:56 PM SENATOR STEVENS asked whether SB 148 had a fiscal note and whether the bill would go to the Senate Finance Committee. CHAIR REVAK answered that SB 148 would go to the Senate Finance Committee. He noted that the committee previously heard public testimony. 4:44:25 PM CHAIR REVAK found no further questions or discussion and solicited the will of the committee. 4:44:35 PM At ease. 4:45:13 PM CHAIR REVAK reconvened the meeting. 4:45:17 PM SENATOR MICCICHE moved to report the CS for SB 148(RES), version 32-LS1144\O, from committee with individual recommendations and attached fiscal note(s). CHAIR REVAK found no objections and CSSB 148(RES) was reported from the Senate Resources Standing Committee. 4:46:14 PM There being no further business to come before the committee, Chair Revak adjourned the Senate Resources Standing Committee meeting at 4:46 p.m.
